Introduction & Agreement

These Terms of Service ("Terms") govern your access to and use of the Gourmet Choice Coffee website, online store, and related services (collectively, the "Services"), operated by Gourmet Choice LLC ("Gourmet Choice Coffee," "we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

We may update these Terms from time to time. When we make material changes, we will post the revised Terms on this page with an updated "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

Eligibility & Account Registration

You must be at least the age of majority in your jurisdiction (or have the consent of a parent or legal guardian) to use the Services and make purchases from Gourmet Choice Coffee. By using the Services, you represent and warrant that you meet these eligibility requirements.

To access certain features (such as viewing order history or managing saved addresses), you may need to create an account. You agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Orders, Pricing & Payments

All orders placed through our website are offers to purchase products in accordance with these Terms. We may accept or decline your order at our discretion, including after sending an order confirmation email. We reserve the right to limit quantities or refuse any order if we believe it may violate these Terms or applicable law.

We strive to display accurate product information, pricing, and availability, but errors may occur. If we discover an error in the price or availability of a product you have ordered, we will contact you with options to reconfirm or cancel your order. If we are unable to contact you, we may cancel the order and issue a refund if payment has already been made.

Prices are shown in the currency indicated on the website and are subject to change without notice. Applicable taxes, shipping, and handling charges will be added at checkout. You are responsible for any customs duties or import taxes that may apply to international shipments, if offered.

Payments are processed securely by our third-party payment processor, Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize Stripe to charge the full amount of your order. We do not store your full credit card number or CVV on our servers.

Shipping, Delivery & Risk of Loss

We will arrange for shipment of the products to the address you provide at checkout. Any delivery dates or timeframes provided are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery of the products to the carrier.

Please verify your shipping address carefully before submitting your order. We are not responsible for delays or failures in delivery resulting from incorrect or incomplete addresses provided by you.

Returns, Refunds & Cancellations

Because coffee is a perishable and food-related product, we generally cannot accept returns of opened items for resale. However, your satisfaction matters to us. If there is an issue with your order (for example, your shipment arrived damaged, or you received the wrong item), please contact us within a reasonable time at gourmetchoiceeats@gmail.com, and we will work with you in good faith to address the problem, which may include a replacement or refund at our discretion.

We may allow order cancellations or changes before your order has been roasted or shipped. Because roasting and fulfillment may begin shortly after you place an order, we cannot guarantee that cancellation requests will be honored in all cases.

Acceptable Use & Prohibited Activities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates applicable local, state, national, or international law or regulation.
• Engage in fraudulent or deceptive practices, including payment fraud or chargeback abuse.
• Interfere with or disrupt the operation of the Services, including by introducing viruses, malware, or harmful code.
• Attempt to gain unauthorized access to any accounts, systems, or networks connected to the Services.
• Use any automated means (such as bots, crawlers, or scrapers) to access or collect data from the Services without our prior written consent.
• Infringe upon or violate our intellectual property rights or the rights of others.

Intellectual Property

The Services, including all content, text, graphics, logos, images, product names, and other materials (collectively, "Content"), are owned by or licensed to Gourmet Choice LLC and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved by Gourmet Choice LLC and its licensors.

You may access and use the Services and Content solely for your personal, non-commercial use in connection with browsing and purchasing products from Gourmet Choice Coffee. You may not copy, reproduce, modify, distribute, display, or create derivative works from the Content without our prior written permission, except as otherwise permitted by law.

User Content

If the Services allow you to submit reviews, comments, or other content ("User Content"), you retain ownership of any intellectual property rights that you hold in that content. By submitting User Content, you grant Gourmet Choice LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute such content in connection with operating and promoting the Services.

You are solely responsible for your User Content and represent and warrant that your submissions do not violate these Terms or the rights of any third party. We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS SOLD THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components. Your use of the Services is at your sole risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOURMET CHOICE LLC, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GOURMET CHOICE LLC FOR PRODUCTS PURCHASED THROUGH THE SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Indemnification

You agree to indemnify, defend, and hold harmless Gourmet Choice LLC and its owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Services, (b) your violation of these Terms, or (c) your violation of any third-party rights, including any intellectual property or privacy rights.

Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in California, and you hereby consent to the personal jurisdiction and venue of such courts. Before initiating any formal dispute, you agree to first contact us to attempt to resolve the matter informally in good faith.

Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gourmet Choice LLC regarding your use of the Services and supersede any prior or contemporaneous agreements, communications, or understandings.
